The Terrorism (Protection of Premises) Act 2025 (Commencement No. 2) Regulations 2026

Published: Wed 10th Jun 26

These Regulations, formally titled the Terrorism (Protection of Premises) Act 2025 (Commencement No. 2) Regulations 2026, specify that certain provisions of the primary 2025 Act will officially come into force on 15th June 2026.

Specifically, this commencement activates sections relating to the Security Industry Authority's (SIA) obligations to produce mandatory guidance, subject to the Secretary of State's approval, and the requirement for the SIA to produce and publish a statement detailing the constitution of 'qualifying worldwide revenue'.

Arguments For

  • Ensures the operational effectiveness of key regulatory aspects of the main Act by bringing specific sections into force on a set date.

  • Enables the Security Industry Authority (SIA) to establish necessary guidance and address financial oversight related to premises protection, crucial for national security measures.

  • Fulfills the legislative timetable established for implementing the Terrorism (Protection of Premises) Act 2025, providing certainty to stakeholders.

Arguments Against

  • Implementation of specific commencement regulations can be disruptive to businesses required to comply with new SIA guidance and revenue reporting obligations.

  • The exclusion of section 12(2)(c) in this commencement order may delay a specific aspect of the SIA's guidance production or approval process.

  • Any delay or piecemeal commencement of related statutory powers can create uncertainty regarding the full scope of compliance required under the primary legislation.
