The Judicial Review and Courts Act 2022 (Commencement No. 7) Regulations 2026

Published: Thu 2nd Jul 26

These regulations bring into force specific provisions of the Judicial Review and Courts Act 2022 that manage the relationship between standard civil court procedures and new digital legal processes in England and Wales.

The order directs that paragraph 2 of Schedule 4 and part of section 31 of the Act take effect simultaneously with the Online Procedure (Rules and Practice Directions) Rules 2026.

These provisions primarily apply to the judiciary and legal professionals by clarifying that Civil Procedure Rules and existing practice directions shall not apply to online proceedings unless specifically authorized by digital-procedure-specific regulations or directions.

Arguments For

  • The regulations facilitate the transition to digital litigation by bringing into force amendments that define the hierarchy between traditional Civil Procedure Rules and new Online Procedure Rules.

  • Proponents, as indicated in the explanatory note, state that these changes ensure Civil Procedure Rules do not inadvertently conflict with proceedings specifically governed by the Online Procedure Rules.

  • The document notes that the commencement is synchronized with the Online Procedure (Rules and Practice Directions) Rules 2026 to ensure a consistent legal framework upon implementation.

Arguments Against

  • Legal practitioners may express concern regarding the complexity of determining which set of rules applies when proceedings transition between online and traditional formats.

  • Critics might argue that tying the commencement to the entry into force of separate rules (S.I. 2026/696) creates a secondary layer of administrative complexity for court users tracking effective dates.

  • Some stakeholders may question whether the exclusionary nature of the amendments—restricting traditional Civil Procedure Rules from online proceedings—might lead to procedural gaps if the online rules are not exhaustive.
