The Sentencing Act 2020 (Special Procedures for Community and Suspended Sentence Orders) (Amendment) Regulations 2025

Published: Thu 20th Nov 25

These Regulations, made under powers in the Sentencing Act 2020, amend previous regulations from 2023 and 2024 concerning special procedures applied to community orders and suspended sentence orders.

Specifically, the amendment extends the qualification period for these special procedures for both sets of previous regulations until March 31, 2029, ensuring that specified cases continue to receive this treatment if the relevant order is made by that date.

Arguments For

  • Extends the duration of special procedures for community and suspended sentence orders under the Sentencing Act 2020, ensuring continued application for offenders sentenced up to March 31, 2029.

  • Provides necessary administrative consistency by aligning the expiry timelines of the 2023 and 2024 Regulations, which previously had different implicit cut-off dates.

  • Maintains legislative continuity regarding a specific sentencing measure established under Section 395A of the Sentencing Act 2020.

Arguments Against

  • Modifies existing regulations (2023 and 2024) whose initial time limits may have implied a sunset for these specific special procedures, potentially extending measures beyond initial legislative intent.

  • Creates a fixed end date (March 31, 2029) for this extension, necessitating future legislative action to review or further amend the procedural treatment of these sentencing orders past that date.

  • Alters procedural deadlines for orders in England and Wales, which requires administrative adaptation by the courts and probation services.

The Secretary of State makes these Regulations in exercise of the powers conferred by section 395A(1) and (5) of the Sentencing Act 2020.
