The Air Navigation (Restriction of Flying) (Falkirk, Scotland) (Emergency) (Revocation) Regulations 2026

These Regulations, made by the Secretary of State for Transport under powers granted by the Air Navigation Order 2016, immediately revoke the Air Navigation (Restriction of Flying) (Falkirk, Scotland) (Emergency) Regulations 2026, because the Secretary of State determined that the emergency situation necessitating the previous flying restrictions in the specified Falkirk area no longer exists and is not considered necessary in the public interest.

Arguments For

  • Ensuring that necessary safety restrictions on airspace are lifted promptly once the emergency reason is concluded, thereby restoring normal aviation operations.

  • Upholding the principle that restrictions on legitimate activities, such as civil aviation, should only remain in place as long as strictly necessary in the public interest.

  • Providing clear legal certainty to pilots and aviation operators by formally revoking the previous Statutory Instrument (S.I. 2026/228).

Arguments Against

  • As the document is a revocation, arguments against it would primarily relate to the initial necessity of the restriction itself, which this instrument does not debate, only reverses.

  • Potential minor administrative lag if users rely only on outdated navigational aids not immediately reflecting the revocation.
