The Air Navigation (Restriction of Flying) (Burghfield) (Emergency) (Revocation) Regulations 2025

These regulations revoke the Air Navigation (Restriction of Flying) (Burghfield) (Emergency) Regulations 2024, which imposed temporary restrictions on unmanned aircraft flights near Burghfield.

The Secretary of State determined that the emergency justifying these restrictions has ended, and the revocation is in the public interest.

The regulations came into force immediately upon signing on February 11th, 2025.

Arguments For

  • The revocation of the restrictions removes unnecessary limitations on drone operation in the Burghfield area.

  • Lifting the restrictions supports businesses and individuals using drones for legitimate purposes.

  • The decision to revoke demonstrates responsiveness to changing circumstances and public interest.

  • Continued restrictions after the emergency's end would impede economic activity and citizen convenience, thus warranting the revocation.

  • The legal basis for removing the restrictions is clearly defined, adhering to Article 239 of the Air Navigation Order 2016.

Arguments Against

  • The removal of restrictions might unintentionally increase the risk of drone-related incidents near Burghfield.

  • The perceived urgency might have lacked thorough investigation regarding potential risks.

  • Failure to account for possible recurrence of the emergency situation necessitates more advanced measures.

  • A period of consultation before the complete revocation of restrictions could provide input and identification of gaps before action.

  • Sudden revocation without any time-bound surveillance plan may result in uncontrolled usage of drones.
